Public prosecution case

Criminal charges against violation of children rights

The First Children Embassy in the World Medjasi and the Association for Protection of Children Rights have pressed criminal charges to the Public Prosecution against criminals who distribute and sell private amateur porno recordings to the public, showing a minor from a school in Skopje. Both organizations that work on protection of children rights press the charges on the basis of information published in the electronic media and the press on 22 December 2004. They quote the daily newspaper “Dnevnik”, which among other things writes: “The video material, where the main actors are a sixteen-year old student from Skopje and her boyfriend is sold at the Internet cafes for 100-20 denars. The scandalous material lasts for about half an hour and shows explicit sexual scenes…”. The criminal charges call upon the Criminal Law, act 152, paragraph 1 and 3 for illegal recording, as well as act 174 paragraph 2 for promoting personal and family occasions.

MEDJASHI and the Association for Children Rights (ACR) emphasize that this is a case of rough violation of the right to privacy, right for dignity and personal integrity and call the state to act in accordance with the Children Rights Convention, which was signed by the Association itself. Act 34 from the Convention states that the member-countries respectively take all necessary measures to prevent the exploitation of children for pornographic shows and magazines. Act 15 from the Convention also states that no child shall be exposed to free-willing or illegal interfering in his/her private and family life and illegal assaults on his/her dignity and reputation. Both organizations are expecting that the Public Prosecutor press charges against this criminal act and those who did it.
